Hulk Hogans family is taking formal steps to investigate the circumstances surrounding the WWE legends death.

According to court records obtained by POST Wrestling, Hogans widow Melanie Sky Daily, his son Nick Bollea, and financial adviser Terry McCoyrepresenting Hogans estatefiled a petition in Pinellas County last week seeking a 90day extension under Floridas statute of limitations.

The filing explains that the family intends to use the extra time to examine whether to move forward with a medical malpractice lawsuit. While no lawsuit has yet been filed and no defendants have been named, the petition lists Tampa General Hospital, Morton Plant Hospital, two Florida-based doctors, and any and all other applicable health care providers as potential parties under review.

Florida law allows prospective plaintiffs to automatically extend the legal window for 90 days while evaluating whether to proceed with a malpractice claim. Daily believes Hogans phrenic nerve, which controls breathing, was compromised during a neck procedure he underwent in May 2025, a surgery she says contributed to the 71yearold Hall of Famers death.

Hogan was found unresponsive at his Clearwater Beach home on July 24 and later pronounced dead at Morton Plant Hospital. Police at the time stated there was no foul play suspected, though Clearwater Police confirmed in August that they had opened an investigation into Hogans death. Daily also ordered a private autopsy as part of her own investigation into potential malpractice claims.

Under Florida law, medical malpractice claims must be filed within two years of the incident or its discovery, but no later than four years from when the alleged malpractice occurred. By filing this petition, Hogans estate effectively adds three months onto the deadline to preserve flexibility while they gather records and consult with experts.

This isnt the first time Hogans medical care has been scrutinized. In 2013, Hogan filed a medical malpractice lawsuit over a different spinal procedure, which he later settled in 2015.
