Shawn Chan, the Canadian man accused of stalking WWE star Liv Morgan, has filed a new motion to revoke his pre-trial detention just days after a judge denied his initial request for release.
Chan, whos been in jail since June 2025, submitted the new motion on September 17 before the United States District Court for the Middle District of Florida, arguing that the court made a mistake in keeping him behind bars. According to the motion, Chans legal team claims:
Chans attorneys insist their client lawfully entered the U.S., has no prior criminal record, no history of drug or alcohol abuse, and no reason to flee even if deported, he would simply return home to Canada. Theyre also arguing that the charges against him dont fall under violent crime, terrorism, sex offense, weapons, or drug categories.
The motion also tries to poke holes in the prosecutions case, saying its weak and relies on Chans delusional disorder, which the defense says actually undercuts intent:
They argue that because of this, the government will struggle to prove he intended to intimidate or harass her a key requirement for conviction.
The defense is asking the court to reconsider pre-trial release under strict conditions: court-ordered treatment, a GPS monitor, and a stay-away order to protect Liv Morgan.
This comes after a judge previously rejected Chans bid for release earlier in September, ruling that his proposed stay at a Salvation Army facility is not a significant change in circumstances. The court cited his mental health evaluation, which confirmed a delusional fixation on Morgan, and stated:
A new court hearing is now set for Friday, September 26, where the judge will rule on the updated motion.
